HB302: Clarifying West Virginia's abortion laws.

Planned Parenthood press release in opposition: House Bill 302 bans abortion in almost all cases. The bill includes narrow exceptions, including for a medical emergency, which is defined to apply only when an abortion is necessary to avert the patient's death or when delay would cause a "serious risk of substantial and irreversible physical impairment." Adult survivors of sexual assault would only be able to obtain an abortion within the first eight weeks of pregnancy. Minors who are victims of sexual assault would be subject to additional hurdles: forced notification of a parent, even if the minor is a victim of incestThis bill also requires the patient to provide the police report to the doctor before providing the abortion.

Legislative Outcome: Passed House 69-23-8 on Jul/27/22; passed Senate 21-10-3 on Jul/29/22; signed by Governor Jim Justice on Sep/16/22.

The Supreme Court ruled on abortion, and the law is the law

Asked if he considered himself pro-choice or anti-abortion and what he would have done with the abortion restriction bills that Gov. Tomblin vetoed, Justice did not respond. "I am not in favor of abortion, however the Supreme Court ruled on this, and the law is the law," he said in an emailed statement.
