On Abortion: Increase restrictions for abortion clinics to operate

Legislative Summary: HB57: Women's Health and Safety Act: This bill would provide comprehensive standards [including] physician involvement in abortion or reproductive health centers, and admitting privileges at local hospital required. This bill would require reporting of name of minor child to Human Resources, and reporting the name of the father of the unborn child to law enforcement in certain circumstances.

CNN analysis: Bentley signed a law that he says "has been endorsed by pro-life groups across America." Nikema Williams of Planned Parenthood [said] the new law's requirements would shut down clinics: "Medical experts agree that laws requiring admitting privileges for abortion don't increase health or safety for a woman. They just limit a woman's access to safe and legal abortion."

On Abortion: Prohibit use of fetal tissue from unborn infants

Legislative Summary: HB45: Unborn Infants Dignity of Life Act: To allow parents of deceased unborn infants to provide a dignified final disposition of the bodily remains of these infants. This bill would prohibit the sale of the bodily remains of a deceased unborn infant. This bill would also prohibit the use of or the fetal tissue, organs, or bodily remains of a deceased unborn infant in research or experimentation.

Analysis by Snopes.com: [This bill stems from a 2015 video claiming that fetal body parts were being sold]. Planned Parenthood said, "The promotional video has used deceptive and unethical video editing, and created a fake medical website as well as a fake human tissue website that purports to provide services to stem cell researchers."

On Abortion: Religious/ethical exemption for health care providers

HB95: This bill would give health care providers the authority to refuse to perform or to participate in health care services that violate their conscience; immunity from civil, criminal, or administrative liability for refusing to participate in a health care service that violates their conscience.

Analysis by the ACLU of Alabama: Healthcare providers are exempted from performing certain services related to abortion, sterilization, stem cell research, and cloning based on their religious or ethical beliefs. The bill stipulates an exception for emergencies, but it still allows for discriminatory behavior such as pharmacists who refuse to sell certain contraceptives and doctors who refuse to treat a patient who has had an abortion.

HB84: Alabama Accountability Bill: On tax credits for families with students in failing schools to attend another public or private school and for scholarship donations

NPR analysis: Gov. Robert Bentley has signed a bill that gives tax credits to parents who want to transfer their children from a failing public school to another public or private school. Democrats and teachers' groups say the bill underwent massive changes, including allowing schools to choose which students they will accept. "This is very important to very successful school systems," [one pro-school-choice advocate] says, "especially systems around Birmingham, that don't necessarily want to see a flood of students pouring over their borders and into their school system."

On Education: Protect religious expression by students in school

HB1: Student Religious Liberties Act: This bill would prohibit school districts from discriminating against a student or parent on the basis of a religious viewpoint or religious expression in public schools. This bill would require school districts to allow religious expression in class assignments and artwork, and provide students with the freedom to organize religious groups and activities.

Birmingham News analysis: [Proponents say the bill] ensures students maintain their constitutional rights, mentioning a Tennessee student who was kicked out of school for saying "bless you" after someone sneezed. [Opponents] questioned the need for the bill, saying the First Amendment already gives students this freedom.

On Families & Children: Adoption/foster care agencies may reject LGBTQ parents

HB24 Child Placing Agency Inclusion Act: This bill would prohibit the state from discriminating against child placing agencies on the basis that the provider declines to provide a child placement that conflicts with the religious beliefs of the provider.

Analysis by HRC.org: The bill enshrines discrimination into Alabama law by allowing some state-licensed adoption and foster care agencies to reject qualified prospective LGBTQ adoptive or foster parents based on the agency's religious beliefs. HB24 allows state-licensed child-placing agencies turn away qualified Alabamians seeking to care for a child in need -- including LGBTQ couples, interfaith couples, single parents, or other parents to whom the agency has a religious objection.

On Gun Control: Assume gun restrictions are unconstitutional, even treaties

Legislative Introduction to HB8: The Constitution of Alabama of 1901, provides that every citizen has a right to bear arms in defense of himself or herself and the state. This proposed amendment would provide that every citizen has a fundamental right to bear arms and that any restriction on this right would be subject to strict scrutiny. This proposed amendment would also provide that a citizen cannot be compelled by international treaty or law from taking actions that limit or interfere with the fundamental right to bear arms.

Alabama Policy Institute analysis: Under "strict scrutiny," an Alabama court would presume that a law limiting the right to bear arms was unconstitutional.

On Homeland Security: Create state crime of "theft of valor" for profit

HB2: Stolen Valor Act: This bill would prohibit a person from fraudulently holding himself or herself out to be a recipient of medals awarded to members of the U.S. Armed Forces, with intent to defraud. A violation would be a Class A misdemeanor.

Birmingham News analysis: Alabama has a new law making it a crime to use false claims of military honors or medals in exchange for money, food, lodging or other benefits. Just claiming to have been a decorated soldier is not enough to trigger a prosecution, the person has to also seek or receive a benefit using the claim. The Supreme Court ruled in 2012 that a man who falsely claimed he'd won the Medal of Honor could not be found guilty of a crime under the 2005 Stolen Valor Act. The court cited the 1st Amendment's guarantee of free speech.

On Homeland Security: Sponsored tax credit for hiring unemployed veterans

HB83: Under existing law, certain small businesses may qualify for an income tax or financial institution excise tax credit for hiring recently deployed unemployed veterans who have been discharged within two years. This bill would rename the Heroes for Hire Tax Credit Act of 2012 as the Veterans Employment Act and would allow certain small businesses to qualify for a tax credit for hiring an unemployed veteran regardless of when the veteran was discharged from active service.

Analysis by Alabama Today: Incentive to Hire Veterans Bill: raises the tax credit for businesses that hire unemployed veterans from $1000 to $2000 as well as extends the credit to businesses that hire combat veterans, even if they are not unemployed at the time of hiring.

HB37: Right to work declared in constitutional amendment; membership in or payment of dues to labor union may not be required for employment.

Washington Examiner analysis: Alabama voters approved a ballot measure that added a right-to-work laws. In states without the laws, union leaders typically insist that their contracts with management include provisions forcing the workers to support the union. Union leaders despise the laws, which are associated with declining membership and depleted treasuries.
